In the article entitled ‘Designated Hit’, they discuss expert designation and how recent caselaw affects the ability to strike “improper” experts found in defendant’s supplemental designation — providing an overview of the expert designation process, a discussion of the Fairfax v. Lords (2006) decision, and an analysis about how a recent case, Du-All Safety LLC v. Superior Court (2019), could affect the expert designation process – and all challenges related thereto – for all parties moving forward.
