Panish | Shea | Ravipudi LLP Obtains $30 Million Settlement For Victim in Tractor-Trailer Crash Case

Panish | Shea | Ravipudi LLP attorneys Spencer Lucas, Brian Panish, Tom Schultz and Jake Douglass obtained a confidential $30,000,000 settlement for a 31-year-old man who was catastrophically injured in a freeway crash.

On October 14, 2014, a tractor-trailer driver employed by a staffing agency lost control of his vehicle while speeding onto a freeway onramp. Upon the truck’s impact with the freeway’s center median, the trailer disconnected from the tractor and landed directly on top of the Plaintiff’s car. The Plaintiff sustained incredibly severe and life-threatening injuries, including a traumatic brain injury, and will require 24-hour care and supervision for the rest of his life.

Despite the clear evidence that the collision occurred due to the truck driver’s excessive speed, the staffing agency defendant attempted to assert that the driver was not its employee and that the driver lost control of his vehicle due to a sudden medical emergency. The Court denied motions for summary judgment on both of these defenses.
