New Jersey Ruling Allows Text Senders To Be Held Liable For Crashes

Numerous states have passed bans on texting and driving, but for the first time ever, an appeals court has ruled that the sender of any text message that leads to the driver being distracted to the point where they crash could be held liable for damages.  The ruling comes from New Jersey.  Although the plaintiffs in that particular case being judged were found not to be liable, the court opinion says that’s because they had no knowledge that the person involved in the crash was driving at the time.  But they also stated that if somebody knew the person they were texting was at the wheel, they could be held liable for sending a text to that person.
