On April 18, 20012, Judge William Martinez, U.S. District Court for the District of Colorado, denied defendant’s Motion for Summary Judgment in the case of Pritchett v. I-Flow, and ordered that the matter will proceed to trial on plaintiff’s claims for negligence, strict product liability, fraud and negligent misrepresentation. Defendant I-Flow failed to warn surgeons and patients that continuous infusion of anesthetics directly into the shoulder joint can permanently destroy cartilage, requiring replacement of the shoulder.
