CASE SYNOPSIS
On Monday, September 12, 2011 a $10.5 million settlement was reached for a young woman who was run over by an AC Transit bus. Abby Nichols was represented by Brian Panish and Spencer Lucas of Panish Shea & Boyle LLP.
The $10.5 million is the largest injury settlement reached with AC Transit.

The 23 year old Abby Nichols was ran over in an Oakland cross walk in 2008 by an AC Transit bus. Nichols was trapped under the bus for over fifteen minutes because the bus driver was not sure how to operate a hydraulic device that would have freed the victim.
As a result of the bus accident, Nichols left hip was crushed and had to be replaced. She also suffered a broken pelvis and femur. The severity of the accident left her with permanent nerve damage, which requires her to walk with a cane for the rest of her life. Nichols is undergoing physical therapy and still requires additional surgeries.
The settlement between AC Transit and Nichols was reached as a jury was being seated in Alameda County Superior Court to hear the lawsuit against the transit system.
