Panish Shea & Boyle files class action lawsuit against Power Balance relating to company’s deceptive advertising
Power Balance Wrist Band – Does it improve endurance, balance and flexibility or is it a hoax?
On January 4, 2011, Panish Shea & Boyle LLP and X-Law Group PC filed a class action lawsuit in the Central District of California federal court alleging claims against Power Balance LLC and company owners and operators Josh Rodarmel, Troy Rodarmel, and Keith Kato relating to their deceptive and misleading conduct in marketing, advertising, selling, promoting and distributing Power Balance products in the United States. Power Balance sells bracelets, wristbands, pendants and other accessories and represent that the “Mylar Holograms” contained in every accessory give users physiological benefits they cannot give, including improved balance, strength and flexibility.
After an investigation by the Australian government, Power Balance recently issued a corrective advertisement in Australia stating in pertinent part: “In our advertising we stated that Power Balance wristbands improved your strength, balance and flexibility. We admit that there is no credible scientific evidence that supports our claims and therefore we engaged in misleading conduct in breach of s52 of the Trade Practices Act 1974.” The recently filed case alleges claims for Unfair Business Practices (Business & Professions Code § 17200 Et Seq.), False Advertising (Business & Professions Code § 17500 Et Seq.) and Violations Of Consumers Legal Remedies Act on behalf of anyone who purchased a Power Balance accessory in the United States over the last four years.
