Panish Shea & Boyle Defeats Summary Judgment in Significant Pain Pump Case.

On April 18, 20012, Judge William Martinez, U.S. District Court for the District of Colorado, denied defendant’s Motion for Summary Judgment in the case of Pritchett v. I-Flow, and ordered that the matter will proceed to trial on plaintiff’s claims for negligence, strict product liability, fraud and negligent misrepresentation. Panish Shea & Boyle LLP represents the plaintiff for injuries sustained as a result of a pain pump, which was placed after a shoulder surgery. Defendant I-Flow failed to warn surgeons and patients that continuous infusion of anesthetics directly into the shoulder joint can permanently destroy cartilage, requiring replacement of the shoulder.
